1 of 3: Occasionally, every guard in the city will turn hostile when a guard attacks you due to a failed excuse. If this happens, you should restore a save and try it again.
2 of 3: Instead of leading the guard away and knocking him out, you could try quickly running away from him so that he gives up on you and returns to his post. This won't always stop him from being hostile, but it will always take care of the crime. (If he does remain hostile to you, you can lead him off and beat him up to put a stop to that.)
3 of 3: Also, you could try to maneuver him into hitting someone else and getting caught up in a fight with them. That way they'll all forget about you and your crime.
