Who did the witness see?
1 of 4: If you trust your client, you can eliminate one option. Ultimately, you should pick the option for which you can provide some evidence (even if it isn't conclusive).
2 of 4: Max says he never went over to the plaza, so you shouldn't argue that the witness saw Max.
3 of 4: You know from earlier testimony that Russell Berry must have gotten to the plaza somehow. Thus, either the witness didn't see anyone and Russell walked over to the plaza while the witness was looking for the ring, or the witness saw Russell Berry. You can't really "prove" either one. But you can provide evidence for one of these possibilities.
